These terms and conditions outline the rules and regulations for the use of The Singularity's website/app.
By accessing or using our website/app, you agree to be bound by these terms and conditions, including any additional terms and conditions referenced herein or available by hyperlink. If you do not agree to these terms and conditions, you should not use our website/app.

The content on our website/app, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features, and the like ("Content") and the trademarks, service marks, and logos contained therein ("Marks"), are owned by or licensed to The Singularity, subject to copyright and other intellectual property rights under US and foreign laws and international conventions. Content on the website/app is provided to you AS IS for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners.
Your use of the website/app is at your sole risk. The website/app is provided on an "AS IS" and "AS AVAILABLE" basis. The website/app is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
In no event shall The Singularity, its affiliates, directors, officers, employees, agents, or licensors be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising out of or in any way connected with the use of the website/app or with the delay or inability to use the website/app, or for any content obtained through the website/app, or otherwise arising out of the use of the website/app, whether based on contract, tort, strict liability, or otherwise.
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a weekly, monthly, or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it. You must cancel your Subscription renewal through your online iTunes Account.
Subscriptions will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase. Your iTunes Account will be charged when your in-app purchase is confirmed.
A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide us with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize us to charge all Subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, we may issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
Subscriptions can be managed at any time only through a user's iTunes Account Settings.
We may, at our sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").
You may be required to enter your billing information in order to sign up for the Free Trial.
On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.
At any time and without notice, we reserve the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.
Paid Subscription fees are non-refundable. Please note that if you purchase any subscriptions through the Apple iTunes Store or our iPhone applications, the sale are final, and we will not provide any refunds. Your purchases will be subject to Apple's applicable payment policy, which also may not provide for refunds.
We, in our sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay any modified Subscription fee amounts.
You agree to defend, indemnify, and hold harmless The Singularity, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these terms and conditions or your use of the website/app, including, but not limited to, any use of the website/app's content, services, and products other than as expressly authorized in these terms and conditions or your use of any information obtained from the website/app.
These terms and conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
We may revise and update these terms and conditions from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the website/app thereafter. Your continued use of the website/app following the posting of revised terms and conditions means that you accept and agree to the changes.
We reserve the right to terminate your access to the website/app, without notice and at our sole discretion, for any reason, including but not limited to a breach of these terms and conditions or other inappropriate conduct.
